Mental Health Review Panels
Mental Health Review Panels, often referred to as Hospital Managers’ Hearings, provide a secondary layer of scrutiny regarding the lawfulness of a patient’s detention. These reports evaluate if the clinical grounds for holding a patient against their will remain valid under the Mental Health Act 1983.
Overview
When this report is required
- Hospital Managers’ Reviews are conducted to ensure the patient still meets the criteria for compulsory detention
- Nearest Relative Applications trigger a review when a request for discharge is barred by the Responsible Clinician
- Section Renewal Challenges occur when a patient contests the clinical decision to extend their period of detention
- Discharge Capability Assessments provide an independent view on whether a patient can be safely managed in a less restrictive setting
What the expert assesses
- Nature or degree of the mental disorder
- Risk to patient’s own health or safety
- Potential risk to the safety of others
- Necessity of continued inpatient detention
- Adequacy of the proposed aftercare plan
